Although my setting is last name, first name, it lists the contacts depending on it's mood.
Sometimes after a while it corrects how it shows the names, but sometimes only for some, sometimes not at all.

well, a lot of users reported, that they are problems with a lot of apps on ICS. ICS is very buggy, if you log via adb, then you will see.
anyhow, at first, you have to be sure, that the contacts are stored correct.
next, are you talking about different account types - like: google, local, facebook, etc ...
because as reference you should use local or gmail or EAS. all other are maybe related to the app limited (skype, facebook, and all the other stupid social contact accounts, which are not using the real android API)
what you can try is: alternative sort method - maybe this helps ?

I have very simiral issue with Xperia Pro Gingerbread.
I use last name, first name order and I can assure You that contacts are stored correctly.
Here is what I have:
1. Open DW
2. List appears for a moment in last name, first name order
3. List appears for a longer moment in first name, last name order
4. List appears finally and stays in last name, first name order.

I don't think it's android bug, please follow up.
